Prosecutors filed their response Wednesday to a motion to dismiss the charges against Vito Caselnova, the off-duty Rutland County sheriff’s deputy from Glens Falls. According to WNYT Caselnova was clearly the agressor, say police, in video of the November 19th gunfight that played out on Broadway, as he and three men from Utica had a brief altercation, at which point Caselnova pulled his service revolver on the men.
